Super List Builder Terms of Service

Welcome to Super List Builder (“Super List Builder,” the “Site,” “we,” “our,” or “us”). These Terms of Service govern your registration, membership, purchases, advertising, affiliate participation, and use of the Super List Builder website and services.

By registering for an account, purchasing a product or service, submitting advertising, participating in the affiliate program, or otherwise using the Site, you confirm that you have read, understood, and agreed to these Terms of Service.

1. Eligibility and Age Requirement

You must be at least eighteen (18) years of age and legally able to enter into a binding agreement to register for or use Super List Builder.

By creating an account, you represent that the information you provide is accurate and that you meet all eligibility requirements.

2. One Account Per Member

Each individual may create and maintain only one Super List Builder account unless written authorization for an additional account has been provided by Super List Builder.

You may not create duplicate accounts using different names, email addresses, payment accounts, devices, or other information to manipulate advertising credits, referral tracking, commissions, contests, bonuses, or other Site features.

Duplicate or related accounts created in violation of this policy may be suspended or terminated. Associated advertising credits, referral benefits, and commissions may also be removed or forfeited.

3. Account Information and Security

You agree to provide accurate, current, and complete registration and payment information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring through your account. You must notify Super List Builder promptly if you believe your account has been accessed or used without authorization.

Super List Builder is not responsible for losses caused by your failure to secure your password, email account, computer, mobile device, or other login information.

4. Description of the Service

Super List Builder provides online advertising, list-building, promotional, traffic-generation, affiliate, membership, and related marketing tools.

Available features may include banner advertisements, text advertisements, HTML advertisements, website promotions, member communications, Solo Ads, referral tools, advertising credits, upgraded memberships, educational resources, and other services made available through the Site.

Features, advertising quantities, membership benefits, pricing, commission rates, and availability may be changed, replaced, suspended, or discontinued when reasonably necessary to operate or improve the Site.

5. Email Communications

By maintaining an active Super List Builder account, you agree to receive essential account and service-related communications, which may include:

• Account verification and registration messages
• Password resets and security alerts
• Membership and account-status notices
• Purchase, billing, refund, and payment information
• Commission and affiliate-account notices
• Support-ticket responses
• Policy, service, and system announcements
• Information necessary to administer your account

Essential account and transactional communications cannot be opted out of while your account remains active.

You may also receive promotional communications from Super List Builder and Solo Ad messages when you have elected to receive them. Promotional and Solo Ad communication preferences may be changed through the options provided on the Site or through the applicable unsubscribe instructions.

You agree to maintain a valid email address that can receive Site communications. If your email address repeatedly rejects, blocks, or returns our messages, we may suspend email-related features or your account until a valid email address is provided.

6. Solo Ad Program

Super List Builder may provide a Solo Ad system that allows eligible members to submit promotional email advertisements for delivery to participating members.

Receiving promotional Solo Ads is optional. Members may opt out of Solo Ad messages through the communication preferences or unsubscribe method provided by Super List Builder.

Members submitting Solo Ads are solely responsible for their advertisements, claims, offers, links, products, services, and compliance with applicable laws and Site policies.

Super List Builder provides the advertising platform but does not endorse, recommend, verify, warrant, or guarantee products, services, income claims, business opportunities, or representations appearing in member-submitted Solo Ads.

We may reject, edit, pause, or remove a Solo Ad that violates these Terms, applicable law, or our advertising standards. Approval of an advertisement does not constitute an endorsement or guarantee of its content.

7. Advertising Standards

You are responsible for all advertisements, websites, landing pages, products, services, claims, graphics, files, and links submitted through your account.

Advertising may not contain, promote, or link to:

• Illegal products, services, or activities
• Fraudulent, deceptive, or materially misleading claims
• False or unsubstantiated income representations
• Phishing pages, malware, viruses, spyware, or harmful code
• Content that infringes copyrights, trademarks, privacy rights, or other legal rights
• Hate speech, threats, harassment, or unlawful discrimination
• Obscene, pornographic, or sexually explicit material
• Websites designed primarily to steal information or mislead visitors
• Programs or offers that violate applicable laws or payment-processor requirements
• Any material that may harm Super List Builder, its members, or its service providers

Advertisements must accurately represent the product, service, or opportunity being promoted. Members may not make claims that they cannot reasonably document or support.

Super List Builder reserves the right to reject, remove, suspend, or require changes to any advertisement at its reasonable discretion.

8. Single-Level Affiliate Program and Commissions

A member is not required to purchase an upgraded membership solely to participate in the one-tier affiliate program or earn qualifying direct-referral commissions, subject to the current affiliate rules and payment requirements.

Commissions are earned only after a qualifying purchase has been successfully completed, properly tracked, verified, and has satisfied applicable refund, chargeback, and fraud-review requirements.

Referral tracking may depend on referral links, browser cookies, registration records, or other technical tracking methods. Super List Builder cannot guarantee that a referral will be credited when cookies are blocked, deleted, overwritten, or when the referred person does not use the affiliate’s properly coded link.

Commissions may be withheld, adjusted, canceled, or reversed when associated with:

• A refund, reversal, dispute, or chargeback
• A fraudulent or unauthorized transaction
• A duplicate or self-referred account
• Misleading or prohibited promotion
• Manipulation of referral tracking or Site systems
• A violation of these Terms
• A technical or accounting error

Members are responsible for maintaining correct commission-payment information. Super List Builder is not responsible for a payment sent to an incorrect account because the member supplied inaccurate, incomplete, or outdated payment information.

Members are responsible for reporting and paying any taxes applicable to commissions or other income they receive. Super List Builder may request tax information when required by law or by a payment provider.

9. No Self-Referrals or Commission Manipulation

Members may not refer themselves, create accounts for the purpose of generating commissions, use another person’s identity or payment method to disguise a self-referral, or coordinate transactions intended to manipulate the affiliate program.

Transactions involving matching names, addresses, devices, IP addresses, payment information, or other related information may be reviewed. A relationship between accounts does not automatically establish wrongdoing, but Super List Builder may request reasonable verification before approving commissions.

10. Memberships, Purchases, and Advertising Credits

Paid memberships and advertising purchases provide the benefits described on the applicable purchase page at the time of purchase.

Unless expressly stated otherwise, advertising credits and membership features have no cash value and may not be transferred, resold, exchanged, or redeemed for cash.

You are responsible for reviewing the applicable membership benefits, advertising package, billing terms, and price before completing a purchase.

11. Refund Policy

Super List Builder provides a thirty-day refund period for eligible membership and advertising purchases. A refund request must be submitted within thirty (30) calendar days of the original transaction date.

Refund requests must be submitted through the Super List Builder Help Center and must contain enough information to identify the member and transaction:

Members are encouraged to use and evaluate the purchased membership or advertising features promptly. When a purchase is not suitable, the member should submit the refund request within the stated refund period.

If a refund is issued:

• The purchased membership, advertising, or related benefits may be removed.
• The account may be downgraded to a free membership.
• Unused advertising credits associated with the purchase may be removed.
• Commissions generated by the refunded transaction may be reversed.
• Previously paid commissions associated with the transaction may be deducted from future earnings where permitted.
• The account may be closed when the refund relates to the member’s entire participation in the Site.

Refund requests submitted after thirty (30) calendar days are generally not eligible, except when otherwise required by law.

Filing an unjustified payment dispute or chargeback without first contacting Super List Builder may result in account suspension while the transaction is investigated. Nothing in this section limits any rights that cannot legally be waived.

12. Prohibited Activities

You agree not to:

• Create or operate unauthorized duplicate accounts
• Manipulate clicks, visits, advertising credits, referrals, contests, commissions, or statistics
• Use unauthorized bots, scripts, automated browsing tools, or artificial traffic
• Attempt to gain unauthorized access to the Site, servers, databases, or another member’s account
• Probe, scan, attack, overload, disrupt, or interfere with the Site
• Upload or distribute malicious software or harmful code
• Submit false, deceptive, infringing, or illegal advertising
• Harass, threaten, abuse, or impersonate another person
• Misrepresent your relationship with Super List Builder
• Use Super List Builder for unlawful purposes
• Encourage or assist another person in violating these Terms

13. Anti-Spam Policy

Super List Builder maintains a zero-tolerance policy toward unsolicited commercial email and other abusive promotional practices.

Members promoting Super List Builder or any Super List Builder affiliate link must use lawful and ethical advertising methods and comply with the CAN-SPAM Act and other applicable email, privacy, and advertising laws.

Members may not:

• Send unsolicited commercial email to recipients who have not agreed to receive it
• Use harvested, scraped, stolen, or improperly purchased email lists
• Use false or misleading sender information or subject lines
• Conceal the identity of the sender
• Ignore valid unsubscribe or opt-out requests
• Promote through services claiming to blast advertisements to millions of unknown recipients
• Use Super List Builder’s name, domain, or affiliate links in spam
• Falsely claim that an email or promotion was sent or endorsed by Super List Builder

Members may promote through legitimate advertising channels, including properly managed opt-in email lists, traffic exchanges, safelists, list builders, advertising exchanges, classified advertising, social media, content marketing, and paid advertising, provided the promotion complies with applicable laws and the policies of the platform being used.

A member accused of spam may be required to provide reasonable evidence showing how the recipient subscribed or consented to receive the communication.

Spam complaints may result in advertising removal, commission holds, account suspension, account termination, and cooperation with hosting providers, email providers, payment processors, or legal authorities when reasonably necessary.

14. Earnings and Results Disclaimer

Super List Builder provides advertising, list-building, promotional, affiliate, and educational tools. It does not guarantee that any member will receive traffic, subscribers, referrals, sales, commissions, profits, or other business results.

Individual results depend on many factors, including the member’s offer, experience, effort, advertising, messaging, target market, follow-up, skills, expenses, and market conditions.

Any testimonials, examples, statistics, commission screenshots, or income illustrations are not guarantees or promises of what another member will achieve.

Super List Builder is not an employer, financial adviser, investment adviser, franchise, MLM, or provider of a guaranteed-income opportunity.

15. Third-Party Websites, Offers, and Services

The Site contains advertising and links submitted by members and other third parties. Super List Builder does not control all external websites, products, services, claims, privacy practices, or transactions.

Your decision to visit, join, purchase from, or provide information to a third-party website is made at your own discretion and risk.

You should review the terms, privacy policy, refund policy, earnings disclosures, and reputation of an external website before completing a transaction.

Super List Builder is not responsible for losses, disputes, products, services, representations, or conduct arising from a transaction between a member and a third party.

16. Intellectual Property

The Super List Builder name, Site design, software, graphics, logos, text, training materials, and other original content are owned by or licensed to Super List Builder and are protected by applicable intellectual property laws.

Except for materials expressly provided for affiliate promotion, you may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit Site content without prior written permission.

You retain responsibility for content you submit. By submitting advertisements or other material for display or distribution through the Site, you grant Super List Builder a limited, nonexclusive license to host, reproduce, format, display, and distribute that material as necessary to provide the requested service.

17. Account Suspension and Termination

Super List Builder may investigate suspected violations and may temporarily restrict or suspend an account while an investigation is conducted.

We may suspend or terminate an account for material violations of these Terms, fraud, spam, abusive conduct, security threats, illegal activity, payment disputes, duplicate accounts, or conduct that places the Site, members, service providers, or payment processors at unreasonable risk.

Depending on the circumstances, termination may result in:

• Loss of access to the account
• Removal of advertisements and advertising credits
• Cancellation of unpaid commissions associated with violations
• Removal from the affiliate program
• Blocking of related accounts, devices, email addresses, or IP addresses

Super List Builder may retain records reasonably necessary for fraud prevention, financial reporting, legal compliance, dispute resolution, and enforcement of these Terms.

18. Availability and Modification of Services

We work to maintain reliable service but do not guarantee uninterrupted or error-free access. Maintenance, software updates, technical failures, security incidents, third-party outages, or circumstances outside our control may temporarily affect availability.

We may modify Site features, advertising formats, pricing, membership benefits, and operating policies when reasonably necessary. Material changes affecting existing members will be communicated through the Site, account notices, or email when appropriate.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Super List Builder and its services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

We do not warrant that the Site will always be available, error-free, secure, or free from harmful components, or that advertising will produce any specific number of visits, leads, subscribers, sales, or commissions.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Super List Builder and its owners, operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Site.

This includes loss of revenue, profits, data, advertising opportunities, business relationships, website traffic, commissions, or goodwill.

Where liability cannot legally be excluded, Super List Builder’s total liability relating to a claim will not exceed the amount you paid directly to Super List Builder for the service giving rise to the claim during the six months preceding the event, except where a different limitation is required by law.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Super List Builder and its owners, operators, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from:

• Your violation of these Terms
• Your advertisements, websites, products, services, or claims
• Your infringement of another person’s rights
• Your unlawful or unauthorized use of the Site
• Your email, affiliate, or promotional activities

22. Changes to These Terms

Super List Builder may update these Terms to reflect changes in the Site, business practices, payment requirements, or applicable laws.

Revised Terms will be posted on this page with an updated Effective Date. Continued use of the Site after the revised Terms become effective constitutes acceptance of the changes.

23. Governing Law, Jurisdiction, and Venue

These Terms of Service and any dispute arising out of or relating to Super List Builder, your membership, your purchases, the affiliate program, advertising submitted through the Site, or your use of the Site shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.

Subject to any applicable law that requires a different jurisdiction or venue, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of Super List Builder shall be brought in a state or federal court of competent jurisdiction located in or serving Brazoria County, Texas.

You consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum or lack of personal jurisdiction, except to the extent that such rights cannot lawfully be waived.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.

25. No Waiver

Failure by Super List Builder to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

26. Entire Agreement

These Terms, together with the Privacy Policy, refund information, advertising rules, and other policies published on the Site, constitute the agreement between you and Super List Builder concerning your use of the services.
